1)The listing price is set at a mutually agreed market value determined on the basis of the market conditions and comparable homes.

2)The Seller agrees to permit sales representatives reasonable access to the property daily to show the property to prospective purchasers, and that the property be maintained in “showcase” condition during these times.

3)In the event that the home has not sold within the first 90 days of listing at the agreed price, Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty, will continue to market the Sellers home for an additional 2 months and not charge the Seller any commission whatsoever with respect to the listing portion of the commission. However, the Seller will be responsible for the selling portion of the commission which is payable to the agent/company that brings the Buyer.

4)At ALL times during the listing period, the Seller acknowledges that they will be responsible for the selling brokers portion of the commission regardless of what company originates the offer.

5)The Seller agrees to sign a 5-month Listing Agreement with Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty.

6)If the Seller receives an offer at or above the guaranteed sale price within the first sixty (60) day period, and the Seller rejects said offer, then this Guarantee is null & void

i) List home for sale at the "Fair Market Value" to be agreed upon by Seller & Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty. 

ii) Fair market value will be determined by using software called "Quick CMA", which is a statistical analysis of all the recent sales, pending listings and active listings. This "Quick CMA" shows average listing and sale prices of relevant, comparable homes to the subject property.  "Quick CMA" uses historical data from the Vancouver Island Real Estate Board, and the Victoria Real Estate Board, collected since 1994.

iii) Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty has fulfilled their obligation of this agreement if they bring the Seller an offer that is within 5% of the asking price (Seller does not have to accept the offer). Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty will continue to aggressively market the home for the full, agreed-upon commission.

iv) Seller agrees to reduce the listing price by 5% if we do not receive an offer within 5% of the listing price by the 30th day and another 5% if we do not receive an offer within 5% of the asking price by the 60th day.

v)  Should no offer be received in 90 days within 5% of the current asking price, Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty agrees to waive their listing commission of 3.5% on the 1st $100,000 and 1.5% on the balance, and Seller agrees to pay a fee of 3.5% on the 1st $100,000 and 1.5% on the balance to an agent who brings the buyer. Kristin McDonald and Shawn McDonald PREC* c/o Royal LePage Nanaimo Realty agree to continue to aggressively market the home for sale for the remainder of the listing agreement.

vi) This contract is void should Seller not execute on these agreed terms.

vii)  This offer is not a Brokerage wide offer. Meaning, this offer is not offered by any other Realtor at Royal Lepage Nanaimo Realty.
